Terms and conditions for publishing reviews
CAIRN SPORT offers users the possibility to post reviews on its website accessible at https://www.cairn-sport.com.
Posting a review on the Website implies acceptance of and compliance with these publication conditions (hereinafter the “Publication Conditions”). CAIRN SPORT reserves the right to modify them at any time. Where applicable, we will inform you by updating the date shown at the bottom of these Publication Conditions and, in certain cases, by providing additional notifications (for example, by publishing a notice on the homepage of our Website or by sending you an email).
Article 1 – Purpose of the Website Review Feature
1.1 The review feature allows users to post reviews, tips, advice, suggestions, information, and recommendations about products sold by CAIRN SPORT and to assign them a rating ranging from one star (“Poor”) to five stars (“Excellent”).
1.2 CAIRN SPORT provides users (hereinafter the “User(s)”) with a space solely for storing their reviews for the purpose of publication across all current and future public communication media of CAIRN SPORT, including, without limitation, electronic communication services (in particular the e-commerce websites of the 2RIDE Group and/or any mobile versions) and marketing and/or advertising communication media (email campaigns, mailings, online advertising banners, in-store promotional materials in CAIRN SPORT stores, etc.) published by CAIRN SPORT.
Article 2 – Submission, Badges and Review Ranking
2.1 Any User of the CAIRN SPORT review feature must accept the Publication Conditions. CAIRN SPORT may request proof of authorization from any minor User and, failing that, refuse to publish a review.
2.2 Users may submit reviews under the following conditions:
- spontaneously, on their own initiative, by clicking “Leave a review” on the relevant product page. In such cases, CAIRN SPORT cannot confirm that the User has actually purchased or tested the product. These reviews do not display any specific badge or are identified with a “spontaneous review” badge.
- following receipt of an email inviting them to leave a review for a product they purchased from CAIRN SPORT. As these reviews are requested by CAIRN SPORT following a purchase, they are identified on the Website with a “verified buyer” badge.
2.3 Reviews are displayed by default in chronological order, from the most recent to the oldest. However, users may choose to display them according to other criteria such as usefulness or rating.
Article 3 – Review Content / User Responsibilities
3.1 A review must include a username, a rating, a title, and a description of at least 50 characters.
3.2 The review feature may not be used to publish content that violates public decency, public order, the rights of others, or applicable laws and regulations, including but not limited to:
- defamatory, abusive, obscene, racist, offensive statements or references to illegal activities in any form;
- abuse of freedom of expression, including systematic or non-objective criticism, as well as disparaging or malicious comments;
- content that is violent or pornographic, or that may infringe human dignity, gender equality, or the protection of children and adolescents;
- statements inciting crimes, offenses, violence, discrimination, or racial hatred;
- identity theft, including misuse of a name, email address, or company name;
- reproduction in whole or in part of content protected by intellectual property rights without authorization, including counterfeit trademarks.
3.3 Users agree not to misuse the review feature for propaganda, solicitation, canvassing, or proselytism for professional, commercial, or political purposes (advertising messages, spam content, references to other products, commercial offers, or websites).
3.4 Reviews must not contain, in particular:
- email addresses, URLs, phone numbers, postal addresses, or any other information (first name, last name, etc.) enabling identification of the User or a third party;
- critical comments about other published reviews or their authors;
- comments regarding the medical effectiveness of products;
- comments relating to another product or to issues encountered during orders (delivery issues, etc.);
- comments encouraging purchases from a competitor of CAIRN SPORT.
3.5 Review content must comply with these Publication Conditions.
3.6 Users also agree not to disrupt or interfere with the operation of the CAIRN SPORT review feature.
Users must not attach documents or software to reviews that could damage other users’ equipment or allow unauthorized access to other websites.
Users are responsible for taking appropriate measures to protect their equipment against viruses or intrusion attempts. “Equipment” includes, without limitation, personal computers, PDAs, internet access, software programs, and data.
3.7 Users are solely responsible for all content they submit via the CAIRN SPORT review feature.
Article 4 – Moderation and Publication of Reviews
4.1 Reviews and associated usernames are systematically moderated using software based on predefined keywords set by CAIRN SPORT and, in certain cases, reviewed by moderators prior to publication on the Website.
CAIRN SPORT reserves the right not to publish any review that does not comply with these Publication Conditions. Where applicable, the User will be notified by email.
CAIRN SPORT does not modify reviews but may correct minor spelling or typographical errors without changing the meaning of the submitted review. CAIRN SPORT also reserves the right to remove any review at any time that does not comply with the Conditions of Use.
Once submitted, a review can no longer be modified by the User.
4.2 Reviews are generally published within two to four business days following submission by the User, subject to compliance with the Publication Conditions.
The User will receive an email confirming publication of their review or, failing that, informing them of its rejection. Any subsequent use of the review under the conditions set out in Article 1.2 above will not result in a new email notification.
4.3 Once a review is published on the Website, users may indicate whether they found it helpful and report any content they deem inappropriate via a dedicated link. CAIRN SPORT will review such reports and may remove any non-compliant review.
4.4 Reviews are published on the Website for a maximum period of 10 years. They may be removed by CAIRN SPORT prior to this deadline if they relate to a product that is no longer sold by CAIRN SPORT or whose characteristics have been so significantly modified that the reviews are no longer relevant.
Article 5 – Intellectual Property
5.1 CAIRN SPORT holds all intellectual property rights relating to both the structure and content of the Website review feature (including, without limitation, texts, logos, images, illustrations, photographs, videos, graphic or audio elements, music, icons, layout, graphic charter, software, databases, etc.), or has duly acquired the rights and authorizations necessary for their use. All trademarks and/or logos displayed within the CAIRN SPORT review feature are the exclusive property of CAIRN SPORT or its service providers, partners, or suppliers.
Any use of these elements other than that strictly necessary for the publication of the User’s review as defined herein is prohibited without the express, prior written consent of CAIRN SPORT or the relevant intellectual property rights holder.
More generally, Users agree not to infringe any intellectual property rights (copyright, related rights, sui generis database rights, trademark rights, domain names, etc.) of CAIRN SPORT, companies of the 2ride group, or any third party. Any unauthorized or abusive use may result in appropriate measures or sanctions being taken by CAIRN SPORT or the relevant third party.
5.2 By submitting a review on the Website, Users expressly and free of charge grant CAIRN SPORT the right to publish, reproduce, and display all or part of their reviews and usernames, by any means and on any media worldwide, for a period of 10 years.
Such media may include graphic and paper media, audiovisual, IT, and digital communication media such as CD-ROMs, DVDs, electronic communication services (including the e-commerce websites of the 2ride Group and/or any mobile versions), and marketing and/or advertising media (email campaigns, mailings, online advertising banners, in-store promotional materials in CAIRN SPORT stores, etc.), as well as any media currently known or developed in the future.
This authorization includes, in particular, the right for CAIRN SPORT to freely and free of charge use, reproduce, delete in whole or in part, adapt, publish, translate, create derivative works from, sell, and distribute all or part of the reviews and usernames, notably for commercial, promotional, and advertising purposes.
Article 6 – Personal Data
As part of the review feature, CAIRN SPORT collects personal data (including email address, username, city, age range, gender, skin type, eye color) from Users who submit a review on the Website.
Only fields marked with an asterisk on the submission form are mandatory in order to post a review on the Website. Failing this, the User will not be able to submit their review.
Users are informed that all or part of the personal data collected by CAIRN SPORT may be used by CAIRN SPORT and, where applicable, by its service providers, for the publication of reviews across CAIRN SPORT’s current and future public communication media, including, without limitation, electronic communication services (in particular the e-commerce websites of the 2ride Group and/or any mobile versions) and marketing and/or advertising communication media (email campaigns, mailings, online advertising banners, promotional materials, etc.).
The personal data used for this publication may include: username, city, age range, and gender.
To comply with its legal obligations, CAIRN SPORT may also collect and retain data enabling the identification of any person who contributed to the creation of online content.
